حمل ونقل دریایی، از مهم ترین مباحث حقوق دریایی است و در این مبحث، اصلی ترین مقوله، موارد مسئولیت و معافیت متصدی حمل ونقل است. هدف اصلی این مقاله، ارائۀ راهکار کاهش مسئولیت متصدی حمل و نقل دریایی در مواجهه با امارۀ تقصیر می باشد. پژوهش حاضر به روش توصیفی– تحلیلی انجام شده است. روش گردآوری اطلاعات، روش کتابخانهای و برای گردآوری اطلاعات از قوانین، کتاب ها، پایان نامه ها، رساله ها، مقاله ها، بانکهای اطلاعاتی (داخلی و خارجی) و سایر منابع کاغذی و دیجیتالی استفاده شده است. دراین مقاله چند پرسش کلیدی در مبحث خسارت وارده به کالا در حمل و نقل دریایی و مسئولیت متصدی حمل، بررسی شده است. نخست اینکه، درصورت تلف محموله در حمل و نقل دریایی، اصولاً مسئولیت جبران خسارت به عهدۀ کیست ؟ دوم اینکه آیا متصدی حمل و نقل دریایی، مسئول جبران خسارت می باشد؟ دراین صورت مسئولیت وی مبتنی بر امارۀ تقصیر[1] یا فرض تقصیر است؟ سوم اینکه موارد معافیت متصدی حمل و نقل دریایی یعنی موارد استتثناء که متصدی حمل ونقل فاقد یا معاف از مسئولیت است کدامند؟ و راهکارهای کاهش مسئولیت متصدی حمل و نقل دریایی در مواجهه با امارۀ تقصیریا فرض تقصیر چیست؟ برای پاسخ به پرسش های مذکور، ضمن بیان تعاریف و مبانی مسئولیت ها و معافیت های متصدی حمل، به بررسی و تبیین مبانی مسئولیت متصدی حمل در کنوانسیون های بین المللی حاکم بر حمل و نقل دریایی کالا، حقوق مدنی، حقوق تجارت وحقوق دریایی ایران پرداخته شده و مسئولیت ها و جهات معافیت متصدی حمل و نقل دریایی بیان گردیده است. درنهایت این نتیجه گیری به عمل آمد که صرف نظر از مبنا و ماهیت مسئولیت متصدی حمل و نقل دریایی, وی می تواند با استناد به بعضی از جهات معافیت که در کنوانسیون ها و مقررات بین المللی و قوانین داخلی نیز مورد اشاره قرار گرفته اند از مسئولیت رهایی یابد. در این زمینه، راهکارهایی برای کاهش مسئولیت متصدی حمل و نقل دریایی در مواجهه با امارۀ تقصیر، ارائه شده است.
